Obama Attempts to Intervene in Texas Justice

Yet again President Obama has an issue with the state of Texas. It seems the president is really concerned about a rapist and murderer by the name Humberto Leal Garcia. The Mexican national was found guilty by a Texas jury of the rape and murder of a 16 year old girl in San Antonio. Seems Obama is worked up because the international community is upset Texas is about to give Garcia the needle. When Garcia was arrested the authorities forgot to tell him he had the right to diplomatic representation. Pretty thin mitigating circumstances, wouldn’t you say?

President Barack Obama is attempting to block the execution in Texas on Thursday of a Mexican man because it would breach an international convention and do “irreparable harm” to US interests.

The White House has asked the US supreme court to put the execution of Humberto Leal Garcia on hold while Congress passes a law that would prevent the convicted rapist and murderer from being put to death along with dozens of other foreign nationals who were denied proper access to diplomatic representation before trials for capital crimes.

The administration moved after the governor of Texas, Rick Perry, brushed aside appeals from diplomats, top judges, senior military officers, the United Nations and former president George W Bush to stay Leal’s execution because it could jeopardise American citizens arrested abroad as well as US diplomatic interests. –Guardian.co.uk

Somehow, I don’t think Congress is going to be passing a law to prevent such executions. Not now. Not for this president. Governor Perry has looked at the case and heard the arguments. He has said the sentence should be carried out.

I don’t see Perry changing course on this. A Texas jury had its say and determined the death sentence was warranted. Should be the end of the story and besides we Texans have had this attitude going on for 175 years. Texans aren’t fond of being told or bullied and there is a history with Mexico. Think of this as an unofficial motto:

Texas might officially be “The Friendly State” but it is decidedly unfriendly to killers. As the Texas commedian Ron White says “If you kill someone in Texas, we will kill you back!” And that aint no joke.

Mr Garcia is a convicted murderer under the laws of the soveriegn state of Texas. Just try to . . . Come And Take Him.

SCOTUS would rule 5-4 in favor, Tex, since Kennedy is an internationalist, but probably 8-1 against the issue of standing, that just anybody (incl the President) can send a case to it out of the blue. Constitution specifies how a case can get to SCOTUS, and the issue of consular representation will have to get there the same way the right to an attorney did back in the 60s. Mexico will just have to kiss this killer goodbye and hope for better chances with the Congress. (Not likely, btw).

    • Kiss the killer goodbye… too bad he can’t get the feel of a broomstick used on him the way he tortured that poor girl.

      Interesting that in every report the killer is identified as a Mexican National. I think that translates to an illegal alien living in this country since he was 2 years old.

  2. What happened to this girl was a horrific crime against humanity. That anyone would seek to save this guy’s life speaks about how far the Marxist-in-Chief will go to achieve political ends. Wonder what his stand would be if it had happened to one of his daughters?

    The fact that Garcia has lived an additional 17 yrs since committing this crime is an additional atrocity. Justice should be swift, let alone him getting a merciful way out the door.
